We´re there to facilitate the process, we are there to facilitate a settlement and discuss all of the issues but when it comes to giving legal advice, that is where a party to mediation needs independent legal counsel because that attorney is the person who can give them the advice that they need to make sure that their interests are protected.

As a mediator I always recommend to my mediation clients that they seek independent counsel whether it´s during the course of mediation or at the conclusion of mediation to review the terms of a memorandum of understanding and determine that their interests are protected and that they have handled all of the issues that they wanted to handle during the divorce. My job as the mediator is to facilitate that process. Their attorney’s job at the conclusion or during mediation is to make sure that their interests, legal interests, are protected during that mediation.
